The Immigration Rules set out in detail, which family members of persons in the United Kingdom (UK) can apply for a visa. The rules also set out the detailed evidential requirements that must be met in order for an application to be granted.

Many persons form families when they are in the United Kingdom. The Immigration Rules again describe and set out which family members of a person in the United Kingdom can apply for a residence permit.

However the Immigration Rules do not describe the whole picture. The right to a person’s private and family life is protected by Article 8 of the European Convention of Human Rights .The UK Border Agency must consider a person’s private and family life before making any decision to remove or exclude a person from the UK or not to admit a person, by refusing to grant a visa.

Where children are concerned the law in the UK requires all government bodies to place the best interests of children at the heart of their decision‐making process.
