The appeal route available depends on the decision being challenged and whether a statutory right of appeal exists. Not every refusal can be appealed, and in some cases a different legal route is required.
Appeals are time-sensitive and procedural. Early advice matters.
How immigration appeals work
Most immigration appeals follow a staged structure:
First-tier Tribunal
This is where most appeals are heard. The tribunal considers whether the Home Office decision was lawful and supported by the evidence.
Upper Tribunal
An Upper Tribunal appeal is not a rehearing. It is only available where the First-tier Tribunal made a material error of law.
Judicial review
Where no appeal right exists, or where tribunal remedies are exhausted, judicial review may be available to challenge the lawfulness of a decision-making process.
